因臺灣籍漁船「順得慶888號」非法捕魚事件，2015年10月，歐盟將我國列為打擊「非法、未報告及不受規範漁業」不合作第三國警告名單（黃牌名單）。
歐盟共同漁業政策為重要的漁業規範，而臺灣四面環海，漁業乃重要之產業，臺灣學者對此制裁議題之探討相對較少，因此，如何因應漁業領域之國際規範，值得進一步之研究。
    本文研究目的為下列3項，分別為：
一、歐盟的漁業政策與其規範內涵；
二、歐盟IUU捕魚通則實施情況；
三、探討我國因應IUU黃牌名單之措施。
    本研究將以政策研究法，蒐集整理國內外官方文件、期刊、論文及書籍等文獻，加以分析，對歐盟「非法、未報告及不受規範」漁業通則、制裁程序及漁業政策與法規制定的妥適性，並參考鄰近亞洲國家韓國及泰國的打擊「非法、未報告及不受規範」漁業案例，進行綜合性探討。希望能降低未來臺灣再次受歐盟制裁的機會。
    依據2019年6月27日歐盟官方資料「Questions and Answers － Illegal, Unreported and Unregulated (IUU) fishing in general and in Taiwan」所記載，臺灣在法律架構、遠洋漁業之監控、控制及偵查、水產品可追溯性及與國際合作領域等具體成果，頗受歐盟讚賞。故歐盟於2019年3月訪視行程後，在2019年6月27日解除臺灣「非法、未報告及不受規範」漁業之黃牌警告。經過3年多的努力，我國漁業改革成果終獲歐盟執委會認同，黃牌的解除，是遠洋漁業改革的開端，未來更應善盡國際責任，讓臺灣漁業能符合世界潮流，穩健發展、永續經營。

Due to the illegal fishing incident of the Taiwanese fishing vessel "Shundeqing 888" in October 2015, the European Commission warned and identified Taiwan as uncooperative countries in the fight against illegal, unreported and unregulated (IUU) fishing (yellow card).
The Common fisheries policy (CFP) of the European Union is important to marine conservation. Taiwan is surrounded by the sea and fishery is an important industry. Taiwan scholars have relatively little discussion on this sanctions issue. Therefore, how to respond to the international regulations in the field of fishery is worthy of further study.
The study purposes are the following 3 items:
1.The Common fisheries policy and its normative connotation;
2.Enforcement status of EU IUU fishing regulations;
3.Explore the measures taken by Taiwan to respond to the IUU yellow card.
The study will use “Methods for Policy Research” to collect and read domestic and foreign official documents, journals, theses and books and analyze the EU’s fight against" illegal, unreported and unregulated (IUU)” fishing regulations, sanctions procedure and fishery policies. The study also refers to the "illegal, unreported and unregulated (IUU) " fishing cases in neighboring Asian countries, such as South Korea and Thailand to conduct a comprehensive discussion. Hope to reduce the chance of our country being sanctioned by the European Commission again in the future.
According to the European Commission official information "Questions and Answers-Illegal, Unreported and Unregulated (IUU) fishing in general and in Taiwan" on June 27, 2019, the concrete achievements in Taiwan that led the Commission to lift the yellow card of Taiwan including:
1.Comprehensive review of the distant-water fisheries legal framework. Enforcement of the revised legislation and of the new sanctions scheme.
2.Monitoring, Control, Surveillance（MCS）：Strengthening of the distant-water fleet monitoring and control tools.
3.Enhanced traceability system covering the whole supply chain.
4.International cooperation.
Therefore, after the European Commission’s itinerary in March 2019, it lifted Taiwan’s yellow card warning for “illegal, unreported and unregulated” fishing on June 27, 2019. After more than three years of hard work, the achievements of fisheries reform in Taiwan have finally been recognized by the European Commission. The removal of the yellow card is the beginning of the reform of distant-water fisheries. 
In the future, we should fulfill our international responsibilities, so that Taiwan's fisheries can keep up with the world trend and operate sustainably.
