此論文探討在全球數位經濟背景下中國大陸的社交媒體與第二代互聯網的合規環境。大多全球數市場領導者,例如 Facebook,Youtube和Twitter在大陸市場上是不存在的。這主要是由於中國大陸對互聯網服務提供商有嚴格的限制。許多學者指出這些規定是由於中國大陸政府試圖控制社會中的信息和反對意見。然而本論文欲探討中國大陸互聯網法正在孵化一個可行的中國大陸數位經濟產業。為了支持這一假設,本文將提出中國大陸第二代互聯網及社交媒體產業的定量見解、論述中國大陸互聯網監管的發展和監管環境並比較其對國內及國外服務提供商限制之不同。本論文提出中國大陸之合規性互聯網產業策略可能為中國大陸數位經濟產業孵化其壓倒當前美國數位霸權之力。
英文摘要
The present research investigates Chinese Internet law and the compliance environment of Social Media, Web 2.0  in Mainland China in the context of the Global Digital Economy. Global market leaders such as Facebook, Youtube and Twitter do not have a presence on the Chinese market due to the strict Chinese compliance environment. Commonly, these regulations are attributed to the Chinese government attempting to exercise control over information and the expression of ideas and opinions. Chinese Internet law is first analysed thoroughly from multiple angles, folllowed by an examination of the compliance enforcement strategy followed by the Chinese government. In doing so, this research presents new perspectives on the motivations, objectives, contributions, and implications of Chinese Internet law.
